Terms and Conditions

PLEASE READ THE CONTRACT BELOW...THIS WILL CONFIRM OUR AGREEMENT ONCE YOU BOOK YOUR RESERVATION:   

1. Indemnification And Hold Harmless: You agree to indemnify and hold harmless the Owner for any liabilities, theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with Your use of the property including kayaks, canoe, bikes, sauna, spa equipment and occupancy of the Premises, including but not limited to any claim or liability for personal injury of damage or theft of property which is made, incurred or sustained by You. Owner is not providing any other warranty of any kind, except as otherwise expressly provided herein. The terms “owner” as used in this Agreement shall include their heirs, successors in interest, assigns, employees, agents, and representatives where the context requires or permits. The terms “Tenant”, “You” and “Your” as used in this Agreement shall include Tenant’s heirs, successors, assigns, guests, invitees, representatives and other persons on the Premises during Your occupancy (without regard to whether such persons have authority under this Agreement to be upon the Premises), where the context requires or permits.   

2. Acceptance of Property: Opinions as to the condition of the Property vary from individual to individual and are very subjective. If the Tenant has not personally viewed or inspected the Property, the Tenant shall not rely on any opinions expressed by a third party, including the Landlord or its Agent. The Tenant bears the sole risk of renting the Property sight unseen and in not being satisfied with the condition of the Property at the time of check-in. It is highly recommended that the Tenant personally inspect the Property before signing this Lease. The tenant has not been promised anything as to the condition of the Property unless stated in this lease. The Property is rented “as is”   

3. Dock: Fishing/Boats/Bicycles: The Tenants/Families/Guests bears the sole risk of use and at their own discretion and takes full responsibility of their actions. Landlord is not responsible for any unfortunate incidences caused to anyone utilizing such area. Please aware that the access to the water is not fenced and may not safe for children especially if they are not attended to or supervised.

NOTE: The property banks on a river bed which is muddy with deep sinking mud. It is not accessible for entry without boarding a boat. The inlet can have a strong current and it is not suitable for swimming.

4. Assignment: You shall not assign this Agreement or sublet the Premises in or part.   

5. Disputes: This Agreement shall be governed by and interpreted in accordance with the laws of the State of New Jersey, and shall be treated as though it were executed in the County of Ocean, State of New Jersey. Any action relating to this Agreement shall be instituted and prosecuted only in the courts in New Jersey. You specifically consent to such jurisdiction and to extraterritorial service of process.   

6. Miscellaneous: This Agreement, together with the attachments referenced herein and attached hereto, constitutes the entire Agreement between the parties relating to the subject matter hereof, and supersedes all prior written or oral negotiations, representation or agreements. NO modification of the Agreement shall be binding on either party unless it is agreed by and in writing and signed by both parties. Each section, subsection or paragraph of this Agreement shall be deemed severable and if for any reason any portion of this Agreement is unenforceable, invalid or contrary to any existing or future law, such unenforceability or invalidity shall not affect the applicability of validity of any other portion of this Agreement. Under ANY circumstances, this Agreement may NOT be altered by anyone other than the Owner with full disclosure, otherwise, all funds will be forfeited. For all purposes hereunder, facsimile or electronic signatures shall be deemed to be originals and such signatures shall be given the same effect as would an original signature. 

THE PARTIES ACKNOWLEDGE THAT THEY HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS.
